1. Acceptance of Terms

By downloading, installing, or using the Pixshop mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Pixshop is an AI-powered photo editing application that allows users to enhance, modify, and create images using artificial intelligence technology. The App provides various editing tools including but not limited to:

  • AI-powered photo retouching and enhancement
  • Image filters and adjustments
  • Crop and resize functionality
  • Conversational image generation
  • Creative photo transformation tools

3. Subscription Terms and App Store Compliance

3.1 Subscription Plans

Pixshop offers premium features through subscription plans available for purchase through the App Store. Subscription options may include:

  • Monthly subscription plans
  • Annual subscription plans
  • Premium feature access
  • Increased usage limits

3.2 Billing and Payment

All subscription purchases are processed through the App Store and are subject to the App Store's Terms and Conditions. Payment will be charged to your App Store account upon confirmation of purchase.

3.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Managing Subscriptions

You can manage and cancel subscriptions by going to your Account Settings on your device after purchase. Subscriptions cannot be cancelled during the active subscription period.

3.5 Free Trial

If offered, free trials will automatically convert to paid subscriptions unless cancelled before the trial period ends. You may cancel at any time during the trial period to avoid charges.

4. Refund Policy

All purchases are final and non-refundable except as required by applicable law or App Store policies. For refund requests, please contact Apple Support directly through the App Store, as all transactions are processed by Apple.

4.1 App Store Refund Process

To request a refund for App Store purchases:

  1. Visit reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Find your purchase and select "Report a Problem"
  4. Follow the on-screen instructions

5. User Responsibilities and Prohibited Content

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for all content you create, upload, or share through the App.

5.2 Prohibited Content

You may not use the App to create, upload, or share content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains nudity, sexual content, or is otherwise inappropriate
  • Promotes violence, hatred, or discrimination
  • Contains malicious code or harmful material
  • Violates privacy rights of others
  • Is false, misleading, or deceptive
  • Promotes illegal activities

5.3 Content Monitoring

We reserve the right to monitor content created through the App and may remove or restrict access to content that violates these Terms.

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of images and content you upload to the App. However, you grant us a limited license to process your content to provide the App's services.

6.2 Generated Content

Content generated by the App's AI features belongs to you, subject to these Terms and applicable law. However, you are responsible for ensuring your use of generated content complies with applicable laws and doesn't infringe third-party rights.

6.3 App Content

The App, including its software, design, text, graphics, and other content, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

7. Privacy and Data Protection

8. Third-Party Services

The App integrates with third-party AI services (including Replicate and OpenRouter) to provide image generation and editing features. Your use of these features is subject to the terms and policies of these third-party providers.

9. Disclaimers and Limitations

9.1 Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted availability. The App may be temporarily unavailable due to maintenance, updates, or technical issues.

9.2 AI-Generated Content

AI-generated content may not always be accurate or appropriate. You are responsible for reviewing and approving all generated content before use.

9.3 Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

10. Account Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in prohibited activities. Upon termination, your right to use the App will cease immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or other means. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

12. App Store Compliance

This App is distributed through the Apple App Store and is subject to Apple's App Store Terms and Conditions. In case of conflict between these Terms and Apple's terms, Apple's terms will prevail regarding App Store-related matters.

12.1 Apple as Third Party

Apple is not a party to these Terms and has no responsibility for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

12.2 Compliance with Usage Rules

Your use of the App must comply with the current App Store Terms of Service and Usage Rules.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of your jurisdiction. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts in your jurisdiction.
